Exactly what comprises ADA ‘N0N-COMPLIANCE’ for websites?

What is your exposure? | Does YOUR website need to be compliant?

The ADA (Americans with Disabilities Act) has recently moved its attention to the web and while we are awaiting final guidelines from the Department of Justice (DOJ) due Financial Year 2018, Florida has become the epicenter for nuisance lawsuits targeting small businesses.

The urgency is the fact that groups of Florida lawyers are suing thousands of small business owners and forcing expensive settlements over ADA violations.

These lawsuits have now come to the Tampa Bay Area and all businesses are at immediate risk. This is no longer a question of whether you have ramps, it is now necessary that websites are available to both the blind, deaf and other handicapped individuals. All website content must be checked for compliance and availability to the many software programs these individuals use to search the web. Whether you become a target or not, know that there are adjustments that can be made to your site that will eliminate the risk of getting slapped with a costly lawsuit.

Not only are we completely up to speed on what needs to be done to make your website 100% ADA compliant – we possess the design and programming technical expertise to actually MAKE the necessary changes.  Once your websites are fully compliant, we will update your websites as needed to ensure they stay compliant at no additional charge as long as your web hosting, marketing and support agreement is active.

The good news for potential defendants is, at this time, the only remedies available in private ADA suits are injunctions that force you to come into compliance (at your own cost of course) and cough up attorneys’ fees which  can cost many thousands of dollars.  (NOTE - when the Department of Justice gets involved, law firms can additionally seek civil fines and penalties which can cost tens of thousand dollars).

The DOJ 's intentions are to make WCAG 2.0, Level AA required for virtually all business and education websites.  The WCAG standards are designed to assist vision- and hearing-impaired users, through adaptive software and equipment, easily navigate through websites and understand content of text, images, audio and video, and conduct business by recognizing where to fill out forms. Rules govern how links can be tagged and arranged, and images used as links must include alternative text so vision-impaired users know where they're going.  The standards are intended to be incorporated anytime new content is posted to both desktop and mobile sites.

It is strongly recommend that you are proactive in adding these enhancements to your website BEFORE you are slapped with a lawsuit and know that this is a federal mandate THAT HAS TO BE FOLLOWED REGARDLESS OF WHETHER OR NOT YOU ARE TARGETED BY LAW FIRMS.
